Federal Scholarship Tax Credit: Taxpayer Federal Credit

The Federal Scholarship Tax Credit program (FSTC) offers a unique dollar-for-dollar federal tax credit for any taxpayer who wants to donate some of the money they’d pay in taxes to a scholarship granting organization instead. A tax credit reduces the amount of taxes you owe the government. A tax deduction reduces the amount of your income that you are taxed on. So how does the federal scholarship tax credit work?

Any taxpayer, regardless of if they have children or not, can make a donation of up to $1,700 to an approved Scholarship Granting Organization (SGO) anytime during the calendar year starting in 2027. When they go to file their federal income taxes in the spring of 2028 they can claim a dollar-for-dollar tax credit for the amount they donated.

For example, let’s say you donate $1,000 to an approved SGO in March of 2027. When you file your taxes in April of 2028 you can claim a tax-credit of $1,000.

Taxpayers can donate more than $1,700 to a SGO if they choose to do so, but the maximum that can be claimed on their tax return is $1,700.

Frequently Asked Questions

The federal scholarship contribution tax credit will be available to taxpayers starting in the 2027 tax year. This means that any taxpayer who donates up to $1,700 during the 2027 calendar year to an approved Scholarship Granting Organization (SGO) can claim the tax credit when they file their taxes in 2028.

For taxpayers filing jointly, they can claim up to $3,400 provided each individual taxpayer makes a $1,700 donation.

Scholarship Granting Organizations are non-profit organizations that manage contributions from donors or grants for educational scholarships. For the Federal Scholarship Tax Credit program, approved SGOs must spend at least 90% of the money they raise on qualifying scholarships and can only provide scholarships to students located in the state in which they are an approved organization.

Other requirements that SGOs participating in the Federal Scholarship Tax Credit must meet include:

  • Offering scholarships to at least 10 students who do not all attend the same school
  • Only offering scholarships for qualified expenses as specified by the program’s rules
  • Not “earmarking” or setting aside contributions for any particular student
  • Verifying the income and family size of potential scholarship awardees

By January 1 of each calendar year, states participating in the program must turn in a list of SGOs that meet program requirements. Governors (or others as designated by state law) will submit this list to the Secretary of the Treasury.

Currently, 31 states have indicated they will opt-in to participate in the  Federal Scholarship Tax Credit program. The Treasury Department released updated regulations on October 2, 2026 guiding states in this process.

States have until January 1, 2027 to complete a form opting into the program and until February 15, 2026 to provide a certified list of approved SGOs.

Yes! Taxpayers can donate to any SGO approved to participate in the Federal Scholarship Tax Credit program regardless of where they are located. The tax credit comes through the U.S. Treasury Department and not from any specific state.

States are required to turn in a list of approved of SGOs to the Treasury Department by February 15, 2027. Once lists have been turned in Treasury will publish a list of all approved SGOs on irs.gov – stay tuned for more information!

Any taxpayer who files a Federal 1040 Form can claim a tax credit for a donation to an eligible SGO.

Taxpayers who want to participate in the Federal Scholarship Tax Credit program and receive a credit on their federal taxes can do so by donating to an approved SGO (a published list will be shared on irs.gov).

After making a donation, the SGO will provide taxpayers with a unique donor number as part of a written acknowledgement of no later than January 31 of the calendar year following the donation year.

Taxpayers will then need to use this unique donor number when filing their federal taxes to claim their tax-credit.

If the tax-credit a taxpayer receives from participating in the Federal Scholarship Tax Credit program is greater than the amount they owe in taxes for the year, the excess is carried over to the following year (and can do so for up to 5 years).

There is no minimum donation required to receive a tax credit, you simply receive a credit for the amount you have donated. Each taxpayer can only claim up to $1,700 per year ($3,400 for individuals filing jointly), although they can donate more if they choose to do so.

For individuals filing jointly, each individual taxpayer will need to donate $1,700 to receive the $3,400 maximum credit.

Each state participating in the Federal Scholarship Tax Credit program is required to turn in a list of approved SGOs annually. Once the Treasury Department receives these lists they will publish a list on irs.gov – stay tuned!

No, donating to a qualified SGO does not mean that you will receive a scholarship. Your donation makes you eligible for a tax credit, up to $1,700, on your federal taxes. This means that after you file your taxes you can deduct your donation amount from the total that you owe.

If you are a substantial contributor to an SGO or help run an SGO (or are related to someone who does) you are disqualified from receiving a scholarship from that SGO.
